If workers are not paid then they will not work. If workers don't work then they should not get paid.
Without knowing any details of the contract this is what typically happens with payments to a contractor.
1) the contractor submits a monthly estimate of work done to the Professional of Record for his review. The POR either approves or disapproves the payment. Payments are for the total amount done less a ten percent retainage.
2) If the payment is approved then it is forwarded to the owner for his approval and payment.
The only time any payment is made for work not done is for materials delivered to the site (that is on to property owned and controlled by the owner) Technically, the materials become the property of the owner and that material is not to be removed from the site. Usually, retainge is not taken out of a material payment.
At no time should advance payment be made on any work to be done or materials not delivered to the construction site. If this was done, then shame on the University.
The rules are pretty straight forward and have not changed much since I have been doing this type of work since 1976. I handle private contracts the same way.
Again, lets hope this contract is covered by both a Payment Bond and Performance Bond underwritten by a strong Surety Company.
This could get ugly if what many of you are saying is true. However, without knowing the actual facts involved much of what you might be told is basically hearsay. Keep in mind that there are many technicalities in administering a construction contract. I would be highly suspect of any information coming from anybody that does not have experience in such matters.
I remember my years with Jostens and yearbook bidding-----Had to have the 2 bonds to even step up to the plate---I think that this was actually the first step at the bid openings---NO bonds ----no play!!!!!
Anyone have any updated pics of the stadium? Haven't been able to attend any games this season....been out of town for a while. Wondering how it was looking.
I can upload the pictures I took two months ago and you won't find much change. Chair backs are installed and the brick wall in front is half done. Still no restrooms, press box, suits and club seating. Cover over the stands still not installed. One of the suit owners told me last game that all he got for the $2500 he paid was a dish of crawfish. This project will not be finish untill after the season is over. (maybe). Two years and counting for a 8-10 month job. You did ask for and update.

You're not kidding about it being an 8-10 month project. It probably could have been completed in an even shorter time period. Has the school made any public statements regarding the completion issue?
