The City of Lafayette has filed a judicial demand against the City of Broussard to repeal a recent annexation ordinance approved by the Broussard City Council. In a special Memorial Day meeting, the Broussard City Council adopted a measure to annex a fifty foot by fifty foot parcel of land for a sewer lift station.
According to the LCG legal department, that parcel of land is not contiguous to the existing territorial limits of the City of Broussard, which is required by law.
"...Broussard has no existing sewer facilities in the vicinity of such parcel of land, and moreover, has no legal right to extend services of that type outside of its municipal boundaries," City-Parish Attorney Pat Ottinger said in a written statement.
Just Tuesday the Lafayette City-Parish Council voted to annex the city owned Vieux Chenes Golf Course and Fabacher Park into the city limits. The land was previously annexed by the Lafayette City-Parish Council, but that ordinance was repealed after a lawsuit was filed by Broussard. In that lawsuit, Broussard contended that certain legal publications had not been accomplished as required by law, a claim Lafayette refuted.
"...rather than fight a lengthy, expensive legal battle, it was deemed both prudent and cost-effective to merely repeal the original ordinance and re-adopt a separate ordinance annexing these properties," Ottinger said.
Broussard Mayor Charles Langlinais could not be reached for comment Friday night.
