In 2009 the FOIA was updated. To put that update in basic terms the point was to make getting information easier, faster etc. One of the things emphasized in the updated legislation was to require government agencies (which includes anyone who utilizes federal funds) to approach each FOIA request with " a presumption of disclosure". Another words the requested organization must err to the side of the requester. So if you ask for any documents that were reviewed/viewed/considered for the suspension of Lotief then all the documents produced so far fall within those requirements.
The idea that you could hold documents back because the request wasn't specific enough had been dealt with in case law prior to 2009 but still didn't get much traction thus the bipartisan update to the law in 2009.
Good question. As far as I know the video hasn't been released to the public. There seems to be some precedent for this if students who were not involved appear on the tape and are identifiable. In that case you now have a conflict with student privacy laws. Doesn't mean that they couldn't still win an FOIA request it just isn't as cut and dry as say a paper document where you can redact information with a marker.
Ok. I'll give you that. But my point is, Glasco better be one heck of a recruiter to get top tier talent. Regardless of what you are anyone else think they know about coach Lotief, the man was one heck of a developer of talent. Besides Ashley Brignac, what other highly recruited 5 star softball player came to UL? None. Yet he trained and coached these kids to be All-Americans.
My gut feeling is, Glasco will have to recruit the same level of talent Lotief was recruiting, so he better be as good or better a developer of talent if he wants to succeed here. As great as this softball program has been for the last 25 years or so, it wasn't because all these 5 star athletes were waiting to sign on the dotted line. Those athletes will still be going to OK, SEC schools, UCLA, AZ, OR.....
And if he does succeed here, because he has no ties, he will be gone in a heartbeat, whereas, a homegrown coach who has ties here and wants this program to succeed would have reason for this program to succeed and stick around.
