The judge did not rule whether the athletes were employees of the university or not.
The student "employees" would have had to pay dues to the union. I wonder if the NLRB realized they would have difficulty trying to collect dues from football players who only receive meal stipend dollars.
There were 2 issues. One were they employees of the university and two could they form a union.
